I. Introduction
This document (‘Privacy Policy’) sets out how Everuptive sp. z o.o. with its registered office in Kraków, ul. Grzegórzecka 8/5, 31-530 Kraków, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court for Kraków – Śródmieście in Kraków, XI Economic Division of the National Court Register under KRS number: 0000398401, NIP: 6762449233, REGON: 12241994800000, share capital: 8,300 PLN, tel. : +48 536 195 427, e-mail: kontakt@skillveo.com (‘Everuptive’ or ‘we’), as a controller of personal data within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (‘RODO’), processes Users’ personal data in the course of providing services on www.skillveo.com and on related websites.
All capitalized terms in this Privacy Policy have the meaning given to them in the Terms of Service of Skillveo.com.
This Privacy Policy applies to the personal information of Service Users.

II. Protection of personal data
When you use the Services on the Website you entrust Everuptive with your personal data.
Everuptive processes the following personal data, the provision of which is mandatory for the purposes of Registration and use of the Service:
first names;
surname;
e-mail address.
The provision of the data requested in the Registration form is mandatory and necessary for the performance of the Services. By registering on the Website and using the Services, you consent to Everuptive’s use of your personal data in accordance with the principles set out in this Privacy Policy.
In addition, the following personal data may optionally be provided by Users for the purposes of using the Service, making complaints, the operation of the Service:
contact telephone number;
name of the company which is the Employer;
position with the Employer.
If you use the Services via a mobile device we also store the unique number of that device.
Users’ personal data is processed by Everuptive in order to operate the Service, viz:
the proper performance of the Services set out in the Terms and Conditions;
the provision of the Services available through the Website;
marketing of services provided by Everuptive and marketing of services provided by third parties
third parties (where appropriate consent is given);
handling the Registration process;
logging into the Website;
sending by Everuptive to the indicated e-mail address – in electronic form – a newsletter (newsletter) ordered – in the case of expressing additional consent;
clarify the circumstances of unauthorised use of the Services;
to ensure the smooth functioning of the Service;
to create internal reports and analyses;
compile statistics on sub-pages of the Website;
adapt the Website to the needs of Users;
issue certificates of training completion.
The administrator of the personal data is Everuptive sp. z o.o. with its registered office in Kraków, Grzegórzecka 8/5, 31-530 Kraków, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for Kraków-Śródmieście in Kraków, XI Economic Department of the National Court Register under KRS number: 0000398401, NIP: 676-244-92-33, REGON: 122419948, initial capital: 8,300 PLN.
Everuptive has appointed a Data Protection Supervisor, who can be contacted by e-mail: dane.osobowe@everuptive.com or by phone: +48 536 195 427.
The personal data provided by the User is processed by Everuptive solely for the purpose of operation of the Website, for the performance of the agreement for provision of services electronically (in particular, creation of a User account), handling of complaints, and for the establishment, investigation or defence of possible claims.
The basis for the processing of the User’s personal data by Everuptive is the necessity for the conclusion and performance of the contract between Everuptive and the User, which is concluded by the acceptance of the Terms of Service by the User, the obligation to fulfil legal obligations, as well as the legally justified interest pursued by Everuptive (in particular the establishment, assertion or defence of claims, marketing of Everuptive products and services).
The recipients of Users’ personal data will be:
entities acting on Everuptive’s behalf that provide and support Everuptive’s ICT systems (general ICT infrastructure, email, etc.);
public entities authorised under applicable law to receive personal data.
Personal data will only be shared if there is a legal basis for doing so. In the case of entities providing services to Everuptive (i.e. acting on its order and on its behalf), Everuptive will enter into a data processing entrustment agreement and the data will only be entrusted to entities that guarantee an adequate level of security for the personal data entrusted.
Everuptive shall ensure that all its employees and associates processing the Users’ personal data have been authorised to do so, and are obliged to keep all information confidential and secret.
In relation to the processing of personal data, the User has the right to:
request further information on how his/her personal data is used;
request access to his/her personal data and a copy of the data that has been provided to Everuptive;
to receive in a structured, commonly used machine-readable format the personal data that has been provided and, where technically possible, to request the transfer of that data to another controller without hindrance, where the processing is based on consent or contract and by automated means;
request the rectification of any inaccuracies in the data held by Everuptive;
request the erasure of any data that Everuptive no longer has a legal basis to process;
object to any given processing based on legitimate interest on grounds relating to your particular situation, including profiling, unless our grounds for processing override your interests, rights and freedoms;
request a restriction of processing, e.g. for the duration of a complaint;
withdraw the consent you have given – where the processing is based on consent;
lodge a complaint with the supervisory authority – the President of the Office for Personal Data Protection.

The User’s personal data may be stored by Hetzner GmbH, Gunzenhausen, Industriestrasse 25, 91710 Gunzenhausen, Germany for the purpose of providing hosting services, Google Inc. in the United States, which is listed in Privacy Shield, which means that it guarantees an adequate level of data protection.
Data collected in connection with the User’s use of the Website is subject to automatic analysis. The analysis includes the User’s activity on the Website (e.g. frequency of logging in), the number and duration of playing Video Courses. These activities primarily remind you that you have taken a Video Course within the scope of your Employer Subscription. In addition, such analysis also allows us to improve the performance of the Service Based on the analysis of your activity on the Service in connection with the Subscription purchased by the Employer, reports are created for your Employer about your activity on the Service (including, but not limited to, your performance and your use of the Video Courses). The basis for the analysis of your activity is the legitimate interest of your Employer, to increase your competence in connection with your use of the Video Courses on the Service, and to improve the performance of our Service. However, Everuputive will not make any binding decisions in an automated manner on the basis of your activity on the Service. You have the right to object to profiling activities in any form. If your objection proves to be valid and we have no other legal basis for processing your personal data for a particular purpose, we will cease processing your data for the purpose to which you have objected.
Each User who has registered, after logging in to the Website, has access to all his/her data and has the possibility to update it on the Website, as well as to delete his/her account on the Website.
Personal data will be processed by Everuptive for as long as the User has an account on the Service, this will be necessary to provide the Services. Everuptive will also retain the User’s personal data as necessary to comply with legal obligations, resolve disputes or enforce agreements entered into.
If it is not necessary to process the Users’ personal data for the purposes set out in the Terms and Conditions, the User’s personal data will be deleted.
Everuptive shall not be liable for any actions of third parties, having to do with the Opinions or the scope of the User’s personal data, or for any damage caused to the User as a result.

III. Communication
If you have provided us with your email address or telephone number we will only use these contact details for the purposes of communication related to the provision of the Services. These communications will include information about changes to the terms of the Services, news about the Service, new features on the Service, new Video Courses included on the Service, and information about changes to this Privacy Policy or the Terms and Conditions.
We will not use your contact information to send you information about services provided by third parties unless you have given us your express consent to do so.
We will send you our newsletter (bulletin) or other information if you have given us your express wish to do so. You can withdraw your consent at any time and inform us at kontakt@skillveo.com that you no longer wish to receive such information.


IV. Server log files
Please be advised that as soon as a User or other natural person connects to the Website, information about the number (including IP) and type of the User’s or other natural person’s terminal device from which the User or other natural person connects to the Website appears in the system logs of the Website. Everuptive informs that it will also process, in accordance with the provisions of Polish law, data concerning the number (including IP) and type of the User’s and other natural person’s terminal device using the Service, as well as the time of connection of the aforementioned persons to the Service and other exploitation data concerning the User’s or other natural person’s activity on the Service.
Server log files are used, in particular, to generate anonymised statistics on the use of the Website, to share them with content owners, to analyse the use of the Website, and for technical purposes.
These files will not be directly combined with other personal data provided by you on the Website.


V. Integration with third-party services
On our pages, we use, among other things, Google Analytics provided by Google (Google Inc, US) to generate statistics on the use of these pages.
Certain sub-pages of the Website and other means of communication with Users and other individuals who use the Website may contain so-called ‘web beacons’ (so-called electronic images, also known as blank gifs). Web beacons make it possible to receive information such as e.g. the IP address of the computer to which the page on which the web beacon has been posted has been loaded, the URL number of the page, the time the page was loaded, the type of browser, as well as information contained in cookies, in order to evaluate the effectiveness of our advertisements.


VI. Other provisions
Everuptive declares that it will endeavour to provide Users and other individuals with a high level of security with regard to the use of the Website. Any incidents affecting the security of the transmission of information, including the suspicion of sharing files containing viruses and other files of a similar nature or other content of a similar nature, should be reported to Everuptive at the following e-mail account: kontakt@skillveo.com.
Everuptive declares that the state-of-the-art techniques used to protect the Website are designed to ensure the highest possible level of security of the Accounts and access to data, but for technical reasons cannot fully guarantee the secrecy of the stored and transmitted information.
Users’ personal data is stored in a database in which technical and organisational measures have been applied to ensure an adequate level of protection for the data processed.
If there is a suspicion of misuse of the Website, we shall be entitled to combine the data collected in accordance with this Privacy Policy with other information in our possession in order to identify the misuse and the person responsible for it.


VII. Changes to the Privacy Policy
Our Service is constantly being improved. Changes to the provision of the Service made in the future may affect what data we hold and how we process it.
This Privacy Policy may be updated to reflect such changes, changes in applicable law or improvements in our data processing.
